S T A T U T E
OF THE STATE GEOLOGICAL INSTITUTE OF DIONÝZ ŠTÚR

as of May 31, 2000, No. 20/2000-min.



Article 1
The mission of the State Geological Institute of Dionýz Štúr

 

  1. The State Geological Institute of Dionýz Štúr („Geological Survey“) was established, pursuant to Section 28 of the Act of the National Council (Parliament) of the SR No. 56711995 of the Coll. of Laws - On Budgetary Rules of the Slovak Republic - in the wording of regulations as amended later, by the Decision of the Minister of Environment of the Slovak Republic No. 303/1995 of October 11, 1995. The Minister's Decision of April 26, 2000, No 647/2000-min. about changing the name of the Geological Survey of the Slovak Republic issued the full text of Constitutive Charter of the State Geological Institute of Dionýz Štúr (hereinafter referred to as the ”Institute”).
  2. The State Geological Institute of Dionýz Štúr is a contributory organization, its founder is the Ministry of Environment of the Slovak Republic (hereinafter referred to as the ”the Ministry”).
  3. The seat of the Institute is in Bratislava.

 


Article 2
The roles and responsibilities of the Institute

     The Institute ensures the performance of the state geological survey involving the tasks of geological research and exploration, the creation, use and protection of information system in geology, registration, collection, recording and making available the results of geological works carried out at the territory of the Slovak Republic. In order tu fulfil the above tasks the Institute executes, in particular:

  1. Systematic and comprehensive geological research of the territory of the Slovak Republic with a focus on
    1. research, assessment, documentation and presentation of regularities of the geological development and geological setting of the territory, and geological mapping, including compilation and approbation of geological and thematic maps and implementation of supervision over these activities.
    2. in general, research, assessment, documentation and presentation of hydrogeological conditions (including the geothermal ones) of a territory of interest, compilation of hydrogeological, hydrogeochemical and geothermal maps,
    3. in general, research, assessment, documentation and presentation of engineering geological conditions of a territory of interest and compilation of engineering ­geological maps,
    4. research and assessment of geological factors influencing the environment, including those impacts generated due to human activities, determination and evaluation of geogenous and anthropogenous influences upon the rock environment, soil and water, and compilation of maps of geofactors of environment,
    5. research into geological structures suitable for storage of radioactive and hazardous waste, for establishment, operation and liquidation of facilities for storage of gas, liquids and waste in natural rock structures and underground spaces and research of industrial use of thermal energy of the Earth's crust,
    6. research into regularities of generation and distribution of mineral resources along with compilation of regional maps of deposits and metalogenetic maps and genetic models of deposits of mineral resources,
    7. research into technological characteristics of mineral resources and evaluation of their economic use,
    8. prognosing assessment of resources of raw minerals, ground water and thermal energy of the Earth's crust and their quantification,
    9. identification of occurrences of old workings and their effects upon the surface.
  2. Design, implementation and evaluation of the geological work in:
    1. survey of deposits for the purpose of verification of mineral resources reserves and elaboration of essential documents for physical planning in terms of their use and protection,
    2. hydrogeological survey of sources of ground water, including thermal waters, natural curative and table mineral waters for the purpose of verification of their reserves, their use and protection,
    3. engineering geological survey for verification of engineering geological, geotechnical and hydrogeological conditions of the territory, namely for purposes of construction developments, physical planning and overall territorial stability and elaboration of proposals concerning their stabilization and restoration
    4. survey of geological factors influencing the environment, including those impacts generated due to human activities, determination and evaluation of geogenous and anthropogenous influences upon the rock environment, soil and water
    5. survey of territories for the purpose of setting up, operation and disposal of facilities for the storing of gas, liquids and wastes in natural rock structures and underground spaces for the use of geothermal energy of the Earth's crust and in securing and disposal of old workings and their consequences
    6. technology of treatment and processing of mineral resources for the needs of their further utilisation, including care for the environment.
  3. Design, implementation and assessment of the works of the geological research and survey in the field of:
    1. geophysical works,
    2. geochemical works,
    3. special geological works (mineralogical, petrological, sedimentological, paleontological and other works).
  4. Implementation and interpretation of physico-chemical, mechanical, isotope and other laboratory analyses of geological materials and substances of inorganic and organic origin, which contaminate the environment, and materials of phyto- and zoogenic origin, waste and food.
  5. Implementation and evaluation of chemical-technological analyses of imported mineral resources for the bodies of State administration in the field of standardization, measurement and trial services.
  6. Provision of reference laboratory services for the sphere of geology and analyses of geological materials and rock environment.
  7. Monitoring, collection and processing of data on resources and extraction of raw minerals, the costs and conditions of their use at home and abroad, monitoring the development of consumption and the prices of mineral resources and their application to the policies of the Slovak Republic.
  8. Ensuring the obligations arising for the Ministry of Environment from the Act No 313/1999 Coll. of Laws on Geological Works, and on the State Geological Administration (Geological Act) and Act No. 44/1988 Coll. of Laws on the Protection and Use of Mineral Wealth (the Mining Act), as amended by Act No. 498/1991 Coll. of Laws in this range:
    1. keeping registry of exploration areas,
    2. keeping registry of certificates on exclusive raw mineral deposits,
    3. elaboration of Summary Registry of Raw Minerals Reserves and of the Balance of Exclusive Deposits of the Slovak Republic,
    4. evidence and securing a protection of exclusive deposits,
    5. collection, record keeping and making available the results of geological works, and material geological documentation.
  9. Keeping registers of:
    1. exclusive raw mineral deposits,
    2. non-exclusive raw mineral deposits,
    3. non-economic raw mineral resources,
    4. boreholes,
    5. hydrogeological ant geothermal boreholes,
    6. territory coverage by geological maps,
    7. territory coverage by thematic geological maps,
    8. territory coverage by geophysical survey,
    9. landslides,
    10. solid waste disposals,
    11. historic mining works,
    12. elaboration of further thematic registers.
  10. Creation, use and protection of information system in geology as a subsystem of the information system on the environment and the information system on the territory of the Slovak Republic.
  11. Provision and management the tasks for international cooperation in geology. Ensuring the exchange of information with the international geological information system, cooperation with the geological services of other countries.
  12. Execution of the functions of the Central Geological Library of the Slovak Republic.
  13. Issuance and sale of geological publications, geological and other derivative maps and the results of the geological work.
  14. Execution of the functions of a training institute to graduate in the field of geoscience disciplines for higher scientific degrees.
  15. Execution of the fair expert lecturing, consulting and advisory activities in the area of the main subject of activity.
  16. Processing of documents and information for institutions, domestic and foreign investors about the possibilities of enterprising in the field of geological works, the use of raw mineral resources, groundwater and thermal energy of the Earth's crust and in ensuring the protection of mineral wealth in the physical planning.
  17. Processing of documents for the concept of the geological research and exploration of the territory of the Slovak Republic and draft legislative standards in geological works for the Ministry of Environment.
  18. Execution of geodetic, cartographic and reprographic works in the implementation of geological and other works.
  19. Organization of a conferences, seminars and symposia.
  20. Rental of assets and provision of accommodation services.
  21. Execution of actions in accordance with the Act No 149/1975 Coll. of Laws on Archival Legislation, as amended.
  22. Provision of activities of the Centre of Partial Monitoring System-Geological Factors of Environment.

 


Article 3
Organization units and system of the Institute Management

 

  1. The Institute carries out its work also through regional centres (hereinafter referred to as „the Centre“). The seats of the Centres are Banská Bystrica, Spišská Nová Ves and Košice. If necessary, they can be set up more centres.
  2. The Institute is directed by the Director of the Institute, who is in charge of the Institute's activities. He represents the Institute's statutory body. The Director of the Institute is appointed and revoked by the Minister of Environment of the Slovak Republic.
  3. The Director of the Institute shall appoint and revoke the managers of the Institute.
  4. The Deputy is in charge of the Director of the Institute at the time of his absence within the full range of rights, obligations and responsibilities, with exception of the issues, which are exclusive competence of the Director of the Institute.
  5. The organisational structure of the Institute, the scope of the activities of individual organisational units and their mutual relations are regulated y the Organizational Regulations of the Institute, issued by the Director of the Institute.

 


Article 4
Advisory Bodies of the Director

     Having in mind the quality and efficient management of the Institute, the Director sets up the Scientific Board, Editorial Board, Approbation Commission and other advisory bodies. The chairman and the members of the advisory bodies shall be appointed and revoked by the Director of the Institute. The composition and functioning of the advisory bodies are governed by their organization and procedure orders, issued by the Director of the Institute.


Article 5
Management of the Institute

 

  1. The Institute is a contributory organization with financial relationships linked to the budget of the Ministry. The Institute has autonomous management and under own name assumes the rights and undertakes the commitments.
  2. The Management of the Institute shall be governed by generally binding legal regulations on the management of budgetary and contributory organizations. (Act No. 303/1995 Coll. of Laws on Financial Regulations, as amended).
  3. The Institute manages with its own means and by means of the State Budget, while the assigned activity contribution from the budget of the founder is purposely-designated and specified in the binding outputs of the Ministry.

 


Article 6
The principles Institute's activities

 

  1. The Institute's work is guided by an annual plan of the main tasks which shall be approved by the Minister, and by generally binding legal regulations and other regulations in force of the Ministry.
  2. The implementation of the main tasks of the Institute shall be assessed twice a year. The deduction of the tasks performance shall be submitted to the Ministry in writing by the Director.

 


Article 7
Common provisions

 

  1. Labour-law relations of the staff of the Institute shall be governed by generally binding legislation, in particular the Labour Code, and the regulations issued for its implementation. The rights and obligations of employees of the Institute shall be governed by a Work Order issued by the Director.
  2. The Institute staff payroll conditions shall be governed by the relevant payroll regulations.

 


Article 8
Final provisions

 

  1. The Statutes of the Geological Survey of the Slovak Republic from May 28, 1999, No 18/1999-3, is hereby repealed.
  2. This Statute shall enter into force on June 1, 2000.

DECISION

of the Minister of Environment of the Slovak Republic
August 20, 2008,  No 52/2008 – 1. 8.,

by which is issued

ADDENDUM No 1
to the Statute of the State Geological Institute of Dionýz Štúr from May 31, 2000, No 20/2000 -min.

     Because of the activities updates of the State Geological Institute of Dionýz Štúr

I.   I issue
     Addendum No 1 to the Statute of the State Geological Institute of Dionýz Štúr from May 31, 2000, No 20/2000 -min. (hereinafter referred to as the “Statute“).

II.  I change and amend
     in accord with Sect. I. of this Decision the Statute as follows:

     "1. Into Art. 2 Sect. 1 I insert behind the subparagraph a) new subparagraph b), in wording:
          “b) research in the group of sciences on Earth“.
     2. The original subparagraph b), c) and d) shall be marked c), d) and e).
     3. Into Art. 2, Sect. 1 I insert behind new subparagraph e) a new subparagraph f), in wording:

          “f) research in the environmental management“.

     4. “The original subparagraphs e) to i) will be marked as g) up to k)“.

III. This decision shall take effect on the date of issue.

DECISION

of the Minister of Environment of the Slovak Republic
from September 23, 2009, No 43/2009 – 1. 10.,

by which is issued

ADDENDUM No 2
to the Statute of the State Geological Institute of Dionýz Štúr from May 31, 2000, No 20/2000 -min.

     In accordance with the conclusions of the inspection carried out by the Supreme Audit Office of the Slovak Republic No 1533/2009 of February 5, 2009, and due to the activity updates of the State Geological Institute of Dionýz Štúr.

I.   I issue
     Addendum No. 2 to the Statute of the State Geological Institute of Dionýz Štúr from May 31, 2000, No 20/2000 -min. (hereinafter referred to as the “Statute“).

II.  I change and amend
     in accord with Sect. I. of this Decision the Statute as follows:

     1. In Art. 2 Sect. 8, the words “by Act No 313/1999 Coll., on Geological Works, and on the State Geological Administration (Geological Act) and Act No. 44/1988 Coll. on the Protection and Use of Mineral Wealth (the Mining Act), as amended by Act No 498/1991 Coll. of Laws, „shall be replaced by „from Act No 569/2007 Coll., on Geological Works (Geological Act) as amended by Act no 515/2008 Coll. of Laws establishing and amending certain enactments in the field of care for the environment in connection with the introduction of the Euro in the Slovak Republic and the Act No. 44/1988 Coll. on the Protection and Use of Mineral Wealth (the Mining Act), as amended.“
     2. In Art., 2, Sect. 21, the words ...Act No 149/1975 Coll. of Laws on Archival Legislation “shall be replaced by the ...Act No. 395/2002 Coll. of Laws on Archives and Registries, and supplementing certain laws“.
     3. In Art. 6,  Sects. 1 and 2 are in wording:
           ,, 1.The Institute's work is guided by an annual plan of main tasks and the contract concluded between the Ministry and the Institute to solve the tasks of science and research, informatics, publishing, the activities of laboratories and partial monitoring system, approved by the Minister of Environment y generally binding regulations and internal regulations of the Ministry.
          2. “The Institute shall submit twice a year report on the activities of the Institute within the framework of the contract. The Institute annually submits an evaluation of the implementation of the annual plan of the main tasks. The deduction of the tasks performance shall be submitted in writing by the Director to the Ministry.“

III. This decision shall take effect on the date of issue.
